Agreement to our legal terms

We are Carlos Aarón Osorio López, doing business as MyWealthy ("Company", "we", "us", "our"), located at Blvd. Circuito Guanajuato 22, Int. 22, Col. Santa Clara Ocoyucan, Ocoyucan, Puebla, 72850, Mexico.

We operate the website mywealthy.mx (the "Site"), the mobile application MyWealthy (the "App"), and any other related products and services that refer or link to these Legal Terms (collectively, the "Services").

MyWealthy is a budget tracker app that lets users track accounts, transactions, budgets, and savings goals, and manually track investment holdings. It does not connect to real banks or brokers and does not execute financial transactions — it only records and organizes information the user provides. It includes AI-assisted voice capture and PDF bank statement import features, and requires a subscription to use.

These Legal Terms constitute a legally binding agreement between you and us concerning your access to and use of the Services. By accessing the Services, you confirm that you have read, understood, and agree to be bound by these Legal Terms. IF YOU DO NOT AGREE, YOU MUST NOT USE THE SERVICES.

We will provide you with prior notice of any scheduled changes to the Services. The modified Legal Terms will become effective upon posting or notifying you at contacto@mywealthy.mx. By continuing to use the Services after the effective date of any changes, you agree to be bound by the modified terms.

The Services are intended for users who are at least 18 years old. Persons under 18 are not permitted to use or register for the Services.

1. Our Services

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction where such distribution or use would be contrary to law. The Services are not tailored to comply with industry-specific regulations (HIPAA, FISMA, etc.) — if your interactions would be subject to such laws, you may not use the Services. You may not use the Services in a way that would violate the Gramm-Leach-Bliley Act (GLBA).

2. Intellectual property rights

Our intellectual property

We are the owner or licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, and designs, as well as the trademarks and logos contained therein. Our Content and Marks are protected by copyright and trademark laws.

Your use of our Services

Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable license to access the Services and to download or print a copy of any portion of the Content to which you have properly gained access, solely for your personal, non-commercial use.

No part of the Services or Content may be copied, reproduced, republished, uploaded, posted, encoded, translated, transmitted, distributed, sold, or licensed for any commercial purpose without our express prior written permission. Requests should be sent to contacto@mywealthy.mx.

Copyright infringement

We respect the intellectual property rights of others. If you believe that any material available through the Services infringes upon a copyright you own, please refer to "Copyright Infringements" below.

3. User representations

By using the Services, you represent that: (1) all registration information you submit will be true, accurate, and complete, and you will keep it updated; (2) you have the legal capacity and agree to comply with these Legal Terms; (3) you are not a minor in the jurisdiction in which you reside; (4) you will not access the Services through automated or non-human means; (5) you will not use the Services for any illegal purpose; and (6) your use of the Services will not violate any applicable law or regulation.

If you provide information that is untrue, inaccurate, or incomplete, we have the right to suspend or terminate your account and refuse any current or future use of the Services.

4. User registration

You may be required to register to use the Services. You agree to keep your password confidential and will be responsible for all use of your account and password.

5. Purchases and payment

All payments for MyWealthy are processed exclusively through the Apple App Store or Google Play Store billing systems. MyWealthy does not receive, process, or store your payment card information at any time — the App Store or Play Store manages your payment method directly.

Prices are displayed and charged in the local currency of your App Store or Google Play account region. We may change subscription plan prices from time to time, subject to each app store's policies.

We reserve the right to refuse any order and to limit or cancel quantities purchased, subject to the applicable App Store or Play Store policies.

6. Subscriptions

Billing and renewal

Your subscription will continue and automatically renew unless canceled. You consent to your payment method being charged on a recurring basis without prior approval for each charge, until you cancel. Your billing cycle length depends on the plan you chose (monthly or annual).

Free trial

We offer a 7-day free trial to new users who register. At the end of the trial, you will be charged according to your chosen subscription unless you cancel before it ends.

Cancellation

You can cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Your cancellation will take effect at the end of the current paid term. If you have questions, email us at contacto@mywealthy.mx.

Fee changes

We may, from time to time, make changes to the subscription fee and will communicate any price changes to you in accordance with applicable law.

7. Prohibited activities

You may not access or use the Services for any purpose other than that for which we make them available. As a user, you agree not to:

• Systematically retrieve data from the Services to build a database or directory without our permission.
• Trick, defraud, or mislead us or other users, especially to obtain sensitive information such as passwords.
• Circumvent, disable, or interfere with security-related features of the Services.
• Disparage, tarnish, or otherwise harm us and/or the Services.
• Use information obtained from the Services to harass or harm another person.
• Use the Services in a manner inconsistent with applicable laws or regulations.
• Upload or transmit viruses, Trojan horses, or other harmful material.
• Use automated means (bots, scrapers) to access the Services.
• Delete the copyright or other proprietary rights notice from any Content.
• Impersonate another user or person.
• Decipher, decompile, or reverse engineer any of the Services' software.
• Use a buying agent to make purchases through the Services.
• Use the Services as part of an effort to compete with us.
• Use the Services to advertise or offer to sell goods and services.
• Sell or otherwise transfer your profile.

8. User generated content

The Services let you upload a profile photo and attach images to your transactions. This content is private: it is not publicly posted or shared with other users of the app beyond any budgets or savings goals you have explicitly shared with collaborators you invite.

By uploading content, you represent that you have the necessary rights to it and that it does not infringe any third party's rights. We use this content solely to operate the corresponding feature (displaying your profile photo, displaying the image attached to your transaction) — we do not publish, sell, redistribute, or license it to third parties for commercial or advertising purposes.

We reserve the right to remove any content that, in our reasonable opinion, we consider harmful or in breach of these Legal Terms, and to suspend the corresponding account if necessary.

9. Mobile application license

If you access the Services via the App, we grant you a revocable, non-exclusive, non-transferable license to install and use the App on devices you own, strictly in accordance with these Legal Terms. You shall not: reverse engineer the App (except as permitted by law); modify it; violate applicable laws in connection with its use; remove proprietary notices; use it for unauthorized commercial purposes; or use it to create a competing product.

Apple and Android devices

When you obtain the App from the Apple App Store or Google Play (each an "App Distributor"): the license granted is limited to a device using iOS or Android; we are responsible for maintenance of the App as specified in these Legal Terms, and each App Distributor has no obligation to furnish support; in the event of a warranty failure, you may notify the applicable App Distributor in accordance with its own policies; you represent that you are not located in a country subject to a US government embargo or listed on any US government restricted party list; and you acknowledge the App Distributors are third-party beneficiaries of this license.

10. Social logins

The Services allow you to link your account with your Google or Apple account via social login. By doing so, you represent that you are entitled to share that login information with us without breaching the terms governing your use of those accounts. We may receive certain basic profile information (name, email) from that provider to enable your MyWealthy account.

Your relationship with Google or Apple is governed solely by your agreement with them. We do not review the content of your third-party accounts for accuracy or any other purpose. You can disconnect your Google or Apple account at any time from your account settings or by contacting us.

11. Third-party websites and content

The Services may contain links to other websites or content belonging to third parties. We do not investigate, monitor, or check such third-party websites or content for accuracy, and we are not responsible for them. If you leave the Services to access third-party websites, you do so at your own risk, and these Legal Terms no longer govern that relationship.

12. Services management

We reserve the right, but not the obligation, to: monitor the Services for violations of these Legal Terms; take legal action against violators; restrict or disable access to any part of the Services; and otherwise manage the Services to protect our rights and facilitate their proper functioning.

13. Privacy policy

We care about data privacy and security. Please review our Privacy Policy. By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Legal Terms by reference. The Services are hosted in the United States — if you access them from a region with data protection laws that differ from those of the United States, by continuing to use the Services you consent to your data being transferred to and processed in the United States.

14. Copyright infringements

We respect the intellectual property rights of others. If you believe that any material available on or through the Services infringes upon any copyright you own or control, please immediately notify us using the contact information below. A copy of your notification will be sent to the person who posted the material. Please be advised that you may be held liable for damages if you make material misrepresentations in a notification — if you are unsure that material infringes your copyright, consider contacting an attorney first.

15. Term and termination

These Legal Terms remain in full force and effect while you use the Services. We reserve the right, in our sole discretion and without notice, to deny access to and use of the Services to any person for any reason, including breach of these Legal Terms. We may terminate your account and delete any content you have posted at any time, without warning.

16. Modifications and interruptions

We reserve the right to change, modify, or remove the contents of the Services at any time without notice. We cannot guarantee the Services will be available at all times — we may experience interruptions due to maintenance or technical issues. We will not be liable for any loss or inconvenience caused by your inability to access or use the Services during any downtime.

17. Governing law

These Legal Terms are governed by and interpreted in accordance with the laws of Mexico. Carlos Aarón Osorio López and you irrevocably consent that the courts of Mexico shall have exclusive jurisdiction to resolve any dispute related to these Legal Terms.

18. Dispute resolution

Informal negotiations

To expedite resolution and control costs, the parties agree to first attempt to negotiate any dispute related to these Legal Terms informally for at least 30 days before initiating arbitration. Such informal negotiations commence upon written notice from one party to the other.

Binding arbitration

If the parties are unable to resolve the dispute through informal negotiation, it shall be finally resolved by arbitration in accordance with the UNCITRAL Arbitration Rules in force at the time of commencement. The number of arbitrators shall be one (1). The seat of arbitration shall be Puebla, Mexico. The language of the proceedings shall be English. The governing law shall be the substantive law of Mexico.

Restrictions

Any arbitration shall be limited to the dispute between the parties individually. There is no right for any dispute to be arbitrated on a class-action basis or in a representative capacity on behalf of the general public.

Exceptions

The following disputes are not subject to informal negotiation or arbitration: (a) disputes seeking to protect intellectual property rights; (b) disputes related to theft, piracy, invasion of privacy, or unauthorized use; and (c) any claim for injunctive relief.

19. Corrections

There may be information on the Services that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors and update information at any time, without prior notice.

20. Disclaimer

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES' CONTENT AND ASSUME NO LIABILITY FOR ERRORS, INTERRUPTIONS, UNAUTHORIZED ACCESS TO OUR SERVERS, OR VIRUSES TRANSMITTED THROUGH THE SERVICES.

21. Limitations of liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE LESSER OF: THE AMOUNT PAID BY YOU DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING, OR $100.00 USD. CERTAIN US STATE LAWS AND INTERNATIONAL LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OF CERTAIN DAMAGES — IF THESE LAWS APPLY TO YOU, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

22. Indemnification

You agree to defend, indemnify, and hold us harmless, including our affiliates and employees, from any loss, damage, liability, or claim, including reasonable attorneys' fees, arising out of: your content; your use of the Services; breach of these Legal Terms; breach of your representations and warranties; your violation of the rights of a third party; or any harmful act toward another user with whom you connected via the Services.

23. User data

We will maintain certain data that you transmit to the Services for the purpose of managing their performance, as well as data relating to your use of the Services. Although we perform regular backups, you are solely responsible for all data that you transmit or that relates to any activity you undertake using the Services.

24. Electronic communications

Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, and other communications we provide electronically satisfy any legal requirement that such communication be in writing.

25. California users and residents

If any complaint with us is not satisfactorily resolved, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210 or (916) 445-1254.

26. Miscellaneous

These Legal Terms and any policies posted by us constitute the entire agreement between you and us. If any provision is determined to be unlawful or unenforceable, that provision is deemed severable and does not affect the validity of the remaining provisions. No joint venture, partnership, employment, or agency relationship is created between you and us as a result of these Legal Terms.

27. Investment rebalancing tool & financial disclaimer

MyWealthy is not a registered investment advisor and does not provide personalized investment advice. The portfolio rebalancing feature generates automated share-quantity suggestions based solely on target allocations that you define; these suggestions are mathematical calculations, not recommendations from a human advisor, and do not constitute financial, legal, or tax advice. MyWealthy does not guarantee any investment returns and is not responsible for investment decisions made using this tool. Market prices and exchange rates are provided by third-party sources (including MarketStack, Banxico, and Frankfurter) and may be delayed, inaccurate, or unavailable at times. You should consult a qualified, licensed financial advisor before making investment decisions.

28. AI-assisted features & collaborative budgets

AI-generated suggestions (transaction categorization, PDF statement parsing, voice transcription) may contain errors and should be reviewed by you before relying on them; MyWealthy is not liable for inaccuracies resulting from AI processing. PDF bank statement import is subject to a monthly usage limit, disclosed in the App, to prevent abuse and manage the costs of AI processing; we may change this limit at any time. When you invite other users to collaborate on a shared budget or savings goal, you are responsible for the actions those collaborators take within that shared space, and MyWealthy is not liable for disputes, data changes, or losses arising from collaborator activity.

29. Apple Pay Shortcut integration

The Apple Pay Shortcut integration is an optional, user-configured feature that relies on Apple's iOS Shortcuts functionality and a personal access token. MyWealthy is not affiliated with or endorsed by Apple Inc. for this integration, does not control the availability or behavior of iOS Shortcuts, and is not liable for interruptions, malfunctions, or data inaccuracies resulting from this feature. You are responsible for keeping your personal Shortcut link confidential.
